The City Government of Davao has reconstituted the Anti-Drug Abuse Council (ADAC) through an executive order (EO) signed by Mayor Sebastian “Baste” Duterte on Monday, September 12.
EO 40, Series of 2022, is also known as “An Order Reconstituting The Anti-Drug Abuse Council of Davao City.”
It cited Republic Act No. 7160, which delegated to Local Government Units (I-GUS) the task of improving the quality of life of their constituents, including protection from drug addiction and substance abuse, which contributed greatly to the incidence of heinous crimes.
The Department of the Interior and Local Government (DILG) and the Dangerous Drugs Board (DDB) issued Joint Memorandum Circular NO. 2018-01 on ADAC’s implementing guidelines, its functionality, and its effectiveness.
The joint Memorandum Circular No. 2018-01 also specified the Council’s composition at the local levels and defined their roles and responsibilities.
“Pursuant to said Circular, there is a need to reconstitute anew the Davao City Anti-Drug Abuse Council,” according to EO 40.
ADAC is composed of the city mayor as chairperson, Davao City Police Office (DCPO) director as vice-chairperson, and an action officer identified by the mayor as co-vice chairperson.
The members include the DILG Davao City Office, Office of the City Administrator, City Social Welfare Development Office,
City Health Office, City Information Office, City Legal Office, Department of Education (DepEd) City Division Office, Philippine Drug Enforcement Agency 11, Office of the Liga ng mga Barangay, Davao City Treatment and Rehabilitation Center for
Drug Dependents, and the Bureau of Jail Management and Penology.
Representatives of non-government organizations Davao City Chamber of Commerce and Industry, Inc., Davao Colleges and Universities Network, and the religious sector will also form part of the anti-drug body.
Member-offices will have to name their alternate permanent representative.
Based on the DILG-DDB joint memorandum Circular, the CADAC chairman will attest to the certification declaring the “drug-cleared” status of an affected barangay, certified by the Local Chief of Police and validated by the PDEA regional director. The Council will also monitor the Barangay Anti-Drug Abuse Council (BADAC) and BADAC Auxiliary Team (BAT’s) names, addresses and other significant details, copy furnished the DILG Field Office; receive the consolidated information report from BADAC Chair; review the consolidated reports of cluster leaders for final consolidation and submission to PDEA; and maintain a list of endorsement or referrals of Barangay Duty Officers as to who are drug dependents for screening using the Alcohol, Smoking and Substance Involvement Screening Test (ASSIST).
ADAC is also mandated to establish one-stop-shop facilities where assessment, interview, counseling, referral and/or processing of applications for petitions for the confinement of drug dependents and PWUD who surrendered for treatment and rehabilitation and other allied processes may be undertaken; designate a focal person who shall ensure the compliance and enforcement of DDB Regulations on voluntary Surrender of Drug Users and Dependents and shall coordinate with the appropriate service provider to assure compliance with the prescribed intervention; ensure that the PWUDs who surrendered shall undergo screening in order to determine the level of risk and/or co-morbidities and refer them to the appropriate intervention;
designate certain personnel as the authorized representatives of the DDB who shall cause the processing and filing of petitions for the confinement of drug dependents and PWIJD who surrendered for treatment and rehabilitation before the Regional Trial Courts pursuant to Section 54 and 61 of RA 9165; organize the CADAC Drug Reformation Committee and adopt the Program of Instructions for Drug Reformation Program; and provide for the Community-Based Rehabilitation Program.
The Council will also conduct advocacy and/or preventive education seminars, emphasizing the role of parents and children in the anti-drug campaign, the ill effects of drugs and the consequences of drug abuse; designate a CADAC Secretariat who will collate all reports and maintain periodic statistics on barangay drug-clearing operations for evaluation /analysis and continuing enhancement of process and procedures; and perform other related responsibilities that may be assigned by competent authorities.
DILG Davao City will provide technical and administrative assistance to the ADAC.
Meanwhile, the ADAC chairperson shall appoint an action officer who shall head the Council, ensuring that the body performs its functions efficiently and effectively. The action officer will have to initiate the conduct of activities and formulate plans and programs relative to the campaign against drug addiction and substance abuse.
ADAC will be provided with personnel and equipment from available government funds or resources to enable it to perform its mandates. Its members, technical advisers, and staff are also authorized to claim honoraria and/or incidental expenses relative to the services rendered in addition to their duties and responsibilities and for work beyond office hours, all subject to the usual government accounting and auditing rules and regulations.
