The City Government of Davao created a Special Projects Management Board (BOARD), which is tasked to serve as the policy-making body in the management and development of the units under the Special Projects Division.

Mayor Inday Sara Duterte signed Executive Order (EO) No. 16, Series of 2022, known as “An Order Creating And Constituting The Special Projects Management Board Defining Its Functions, Responsibilities, Jurisdictions, And Establishing Policies, Guidelines, And Rules and Regulations For The Operation Of The Units Of The Special Projects Division (SPD) Under The City Economic Enterprise Office (CEE)” on May 5, 2022.

The mayor, in her EO, said, “There is a need for the creation of a policy-making body to address all the concerns and issues affecting the management of the units under the Special Projects Division of the City Economic Enterprises Office as well as to formulate policies, laws, programs, and recommendations related thereto.”

The EO states that the City Government of Davao owns lands of public dominion and government buildings and facilities for commercial purposes under the units of the SPD of the CEE Office but it has not established a policy-making body that will address concerns and development of the units of the Special Projects Division of the CEE.

The BOARD shall be composed of the city mayor or his/her authorized representative as the chairperson, the assistant city administrator for operations, or his/her authorized representative as vice chairperson.

The BOARD is comprised of the heads or authorized representatives of the CEE, City Treasurer’s Office (CTO), City Legal Office (CLO), City Tourism Operations Office (CTOO), and the Sangguniang Panlungsod Committee on Government Enterprise and Privatization.

The BOARD, however, may recommend additional members appointed by the city mayor in the interest of the service and for the effective discharge of its duties and functions.

Meanwhile, the BOARD is mandated to formulate and adopt policy guidelines and standards in the management and administration of the units under the SPD of the CEE; promulgate rules and regulations governing the operation, administration, and maintenance of the units under the division; conduct a periodic review of the operations of the units under the division; conduct raffle and drawing of lots for the allocation and awarding of vacant stalls/boots or spaces of the units under SPD and certify the results for the mayor’s approval.

It shall also deliberate on the revocation or cancellation of lease contracts, closure of stalls/spaces, or eviction of the lessee from a stall/space for breach of contract, or violation against the provisions of existing laws and ordinances; recommend such measures of action as may be necessary for the resolution of problems, in connection with the use and occupancy of stalls, or space of the units under the SPD; adopt from time to time a budget for the administration and operation of the units under the SPD to be drawn against the budget of the City Government of Davao; and, perform any acts necessary, proper, or incidental to the attainment of the purpose of units under the SPD of the CEE.

But all policies and actions of the BOARD are subject to the mayor’s approval.

The BOARD shall meet at least once a month while special meetings may be convened upon the call of the chairperson or majority of the members. A quorum is reached when the majority of the BOARD members are present.

EO 16 also provides that the Office of the City Administrator Economic Enterprise Management Division (CEE) shall be responsible for providing overall administrative and secretariat services to the BOARD, evaluating rental applications, and recommending for approval by the BOARD.

The existing budget of the CEE and/or the City Government of Davao shall fund the organizational and operational budgetary requirements of the BOARD including the corresponding compensation of personnel.

Areas covered under the SPD of the CEE include a commercial building at San Pedro corner C.M. Recto Streets; Davao City Library Coffee Shop; 2-story Concessionaires Building at the Sangguniang Panlungsod Compound; Davao City Overland Transport Terminal Stalls/Booths; Candelaria commercial spaces in Ecoland; Davao Skate Park at Agdao Flyover; and any existing and future undertaking wherein the operation and management may be assigned to the City Economic Enterprise.
