The City Government of Davao has reconstituted the membership of the Davao City Culture and Arts Council through an executive order (EO).

Mayor Sebastian “Baste” Duterte signed EO 69, Series of 2022, on November 17, 2022.

EO 69 provides that the Sangguniang Panlungsod (SP) adopted Resolution No. 03546 Series of 2004 and City Ordinance No. 0194-04 on February 17, 2004, providing for, among others, the creation of the Davao City Culture and Arts Council, which is under the mandate of the expressed provision of Republic Act No. 7160, otherwise known as the Local Government Code of 1991 (the Code, for brevity).

The new EO cited Section 458 (XVI) of the same Code, which stipulates that the SP shall establish a council whose purpose is the promotion of culture and sports, and coordinate with government agencies and non-government units to ensure support and development.

EO 69 also provides that the Department of the Interior and Local Government (DILG) issued Memorandum Circular (MC) No. 2017-133 on September 29, 2017, revising DILG Memorandum Circular No. 2002-81, entitled “Creation of Local Culture and Arts Councils.”

In the MC, there were additions to the composition and functions of the Local Culture and Arts Council.

“There is a need to reconstitute the membership of the Davao City Culture and Arts Council (DCCAC) so that it may commence discharging its powers and functions in accordance with the provisions in the MC,” EO 69 states.

The city mayor or his duly appointed representative is the chairperson of the DCCAC while the members include the chairpersons of the SP Committee on Education, Science and Technology, and Arts and Culture and SP Committee on Tourism and Beautification, Indigenous Peoples Mandatory Representative (IPMR) to the SP, Museo Dabawenyo head (Secretariat), city planning and development officer, city information officer, city budget officer, and city tourism officer.

The DCCAC shall also be composed of representatives from the Davao City DepEd Division, Commission on Higher Education (CHED) 11, Technical Education and Skills Development Authority (TESDA), Philippine Information Agency (PIA) 11, Tourism Council of Davao City, Davao Historical Society, local museums, local artists groups, business sector or chamber of commerce, professional sector, academe, youth sector, and the National Commission on the Culture and the Arts (NCCA).

As per Item No. 5.0. of DILG Memorandum Circular No. 2017-133, dated September 29, 2017, the Council is mandated to prepare an annual plan on culture, arts, and cultural heritage consonant with the Philippine Development Plan for Culture and the Arts, to be integrated into the local development plan and considered in the annual appropriation ordinances; formulate programs and recommendations to develop and sustain local cultural and artistic talents, cultural industries, traditional and contemporary arts and crafts, and their processes; coordinate with the appropriate affiliated cultural agencies of the National Commission for Culture and the Arts (NCCA) for the conservation and monitoring of national cultural properties found in the LGU; conduct cultural events such as cultural festivals, competitions, lectures, seminars, and symposia; and identify such other programs and activities for the promotion of local cultural heritage and arts.

The operation and necessary expenses of the DCCAC shall be charged to funds made available for the purpose either through the Annual Budget or the Supplemental Budget.
