Acting Mayor Sebastian Duterte has signed on June 10, 2022, the Executive Order (EO) No. 25 Series of 2022 also known as “An Order Creating And Organizing The Program Management Committee (PMC) For The Davao City Sustainable Livelihood And Entrepreneurship Program, Defining Their Duties And Functions And For Other Purposes.”
EO 25 cited Section 9, Article II, of the 1937 Philippine Constitution, which declares that the State shall promote a just and dynamic social order that will ensure the prosperity and independence of the nation and free the people from poverty through policies that provide adequate social services, promote full employment, a rising standard of living, and an improved quality of life for all.
The new EO cited Republic Act 11032 also known as the āEase of Doing Business and Efļ¬cient Government Service Delivery Act of 2018ā mandating the Local Government Unit (LGU) to increase the efļ¬ciency of the delivery of government services and establish effective practices to ensure the timely and efļ¬cient delivery of services and release of ļ¬nancial assistance to its chosen beneļ¬ciaries.
āThe City of Davao, through Ordinance No. 0855-22, Series of 2022, otherwise known as āAn Ordinance Instituting the Davao City Sustainable Livelihood and
Entrepreneurship Program (DCSLEP)ā promulgates the overall guidelines in the provision of financial assistance and livelihood projects to micro and small enterprises to ensure their continuing viability, growth, and enhance productivity thereby uplifting the socio-economic status of MSMEs,ā the EO stated.
Hence, the need to create the PMC of the Davao City Sustainable Livelihood and Entrepreneurship Program (DCSLEP).
The PMC shall be composed of the city mayor or his/her duly authorized representative as chairperson and the city administrator as co-chairperson with the Sangguniang Panlungsod Chairperson on Committee on Cooperatives and People’s Participation, City Cooperative Development Ofļ¬ce, City Veterinarianās Ofļ¬ce,
City Agriculturist Ofļ¬ce, City Social Welfare and Development Ofļ¬ce, and City Mayorās Ofļ¬ce ā Integrated Gender and Development Division as members.
All PMC members are directed to name their respective alternate and permanent representatives in their absence.
The PMC is mandated to oversee the overall operation, implementation, and evaluation of the DCSLEP; formulate and institute policies and procedures not covered by the said ordinance that prescribes the Implementing Rules and Regulations (IRR) of the various Livelihood Programs implemented by each Department as contained in this Ordinance; approve loans from various departments as contained in this Ordinance and sign Loan Agreement (LA) and all instrumentalities as needed thereof; institute safety measures in the regulation of the trust fund accounts; grant condonation and/or amnesty to the beneļ¬ciaries in times of fortuitous event or force majeure that renders the repayment of a beneļ¬ciary impossible; cooperate and collaborate partnerships and networking with international, national and local government and funding agencies as well as nonāgovernment and private sector organizations in support of the program; and,
provide alternative access to funds that will help target beneļ¬ciaries to start, sustain and expand their socio-economic enterprise.
Meanwhile, EO 25 also created the Technical Working Group to assist the PMC in the discharge of its functions and it is responsible for the evaluation and monitoring of all livelihood programs in the city. Representatives from the City Accounting Ofļ¬ce (CAO), City Agriculturist Ofļ¬ce (CAgrO), City Social Welfare and Development Ofļ¬ce (CSWDO), City Treasurerās Ofļ¬ce (CT0), City Legal Ofļ¬ce (CLO), City Budget Ofļ¬ce (CBC), and City Cooperative Development Ofļ¬ce (CCDO) to be designated by the group chairman.
The CCDO shall serve as the PMC Secretariat tasked to handle all of its administrative and secretarial functions.
The DCSLEP funding shall be sourced from the budgetary appropriations provided, including those to be provided in the Development Fund of the City Government of Davao.
Under EO 25, all members, TWG, and technical staff are authorized to claim incidental expenses relative to the services they rendered in addition to their duties and responsibilities and for the work beyond ofļ¬ce hours subject to the usual accounting and auditing rules and regulations chargeable against the budgetary allocation of the committee.
