The City Government of Davao has issued Executive Order (EO) 48, creating an oversight committee on the revision of fees and charges.

Mayor Sebastian Duterte on September 28 signed EO 48, Series of 2022, which recognizes the need for the City Government of Davao to “regularly review, adjust, and adopt a reasonable framework to balance the cost of services rendered for the regulation of business activities and ease of doing business to ensure that all fees and charges imposed by the City are just and reasonable.”

EO 48 cited Department of the Interior and Local Government (DILG) and the Department of Finance’s Joint Memorandum Circular (JMC) No. 2019-01, dated May 17, 2019, entitled “Guidelines for the Review, Adjustment, Setting and/or Adoption of Reasonable Regulatory Fees and Charges of Local Government Units.”

The JMC mandates the creation of an Oversight Committee on the Revision of Fees and Charges to ensure compliance of the guidelines exemplified in the JMC.

The new EO also attributed Section 151 of the Local Government Code, allowing the city “to impose and collect such reasonable fees and charges on business and occupation, and on the practice of any profession or calling, commensurate with the cost of regulation, inspection and licensing before any person may engage in such business or occupation, or practice such profession or calling.”

Th Oversight Committee on the Revision of Fees and Charges was directed to comply with DILG-DOF JMC No. 2019-01. It shall be composed of the city mayor as chairperson, city treasurer as co-chairperson
along with members city budget officer, City Planning and Development coordinator, city accountant, Sangguniang Panlungsod secretary, Liga ng mga Barangay representatitve, city assessor, city engineer, City Building official, city health officer, City Environment and Natural Resources Officer, Permits and Licenses Division head, and City Tourism Operations Office head.

The City Treasurer’s Office (CTO), as a Secretariat, is tasked to handle all administrative and secretarial activities.

The city government’s available funds will shoulder the operating costs of the committee, subject to the usual accounting and auditing rules and regulations.
